General Terms and Conditions of Sale

These general terms and conditions of sale are entered into on the one hand, between SARL Moto Nord de France, whose registered office is located at 18 rue des Champs Elysées 59600 MAUBEUGE, SIRET 821 244 381 00017, owner of the websites motonorddefrance.com/fr/net, and on the other hand, any natural or legal person hereinafter referred to as "THE CUSTOMER" wishing to make a purchase via the website or by any other means.

All customers purchasing products from Moto Nord de France SARL declare that they are of legal age. These general terms and conditions of sale govern the sale of products offered by Moto Nord de France to its customers on the date the order is placed. They apply whether the order was placed via the website www.motonorddefrance.com, another classifieds website, email, telephone, or following a written quote. The customer acknowledges having read, at the time of placing the order, the general terms and conditions of sale set forth on the website www.motonorddefrance.com. This validation constitutes a signature and express acceptance of all transactions carried out with Moto Nord de France SARL. When you have read the general terms and conditions of sale, place an order on the motonorddefrance website, and click on the "VALIDATE ORDER" button, you declare that you fully and unreservedly accept all of these general terms and conditions of sale. Similarly, when you confirm an order following a quote or a telephone conversation with Moto Nord de France, these general terms and conditions of sale shall prevail over any other terms and conditions appearing in any other document, unless otherwise agreed in writing by Moto Nord de France beforehand.

Legal information:

For order processing, shipping, and invoicing, Moto Nord de France requires personal information from the customer. Failure to provide this information will result in the order not being validated. In accordance with the French Data Protection Act of 6 January 1978, the customer has the right (Article 34) to access, modify, rectify, and delete their personal data, which they can exercise by contacting Moto Nord de France.

Orders:

Orders are considered firm and final once accepted via email, telephone conversation, or verbal discussion following a written quote from the seller to the buyer in response to their request. If, due to force majeure, Moto Nord de France is unable to fulfill an order after it has been accepted, validated, and paid for, cancellation will simply result in a refund of all payments made to the customer, without interest or compensation. Moto Nord de France confirms acceptance of the order to the customer at the email address provided or via a direct verbal response to the seller. The sale is only considered final upon confirmation of the order. Moto Nord de France reserves the right to cancel any order from a customer with whom there is an existing dispute regarding payment for a previous order. Any errors in the information provided when placing the order, particularly in the recipient's contact details, are the customer's responsibility; therefore, Moto Nord de France cannot be held liable for the inability to deliver the product.

Price :

According to Law No. 80335 of May 12, 1980, Moto Nord de France retains ownership of the delivered goods until full payment is received from the customer in accordance with the law. To invoke this clause, the seller simply needs to formally notify the buyer of their intention to reclaim the goods by sending a registered letter with acknowledgment of receipt. It is expressly stated, however, that the buyer assumes responsibility for the goods upon physical delivery, as the transfer of possession entails the transfer of risk. Prices are quoted in euros, inclusive of all taxes, but excluding shipping costs. Shipping costs will vary depending on the order. Moto Nord de France reserves the right to change its prices at any time without prior notice, but undertakes to apply the prices in effect at the time the order is placed, except in the case of a manifest error.

Payment methods:

- Bank card

The customer can pay for their order using a bank card. Payment is processed on our partner's secure banking server. The consumer's credit card details are handled securely and are never transmitted unencrypted over the network.

- Check

The check must be drawn on a bank located in metropolitan France and made payable to Moto Nord de France. If possible, and to facilitate order processing, we recommend that the customer print their order confirmation email and include it with their check, clearly indicating the order number. Delivery times will be longer for payments made by check. Order processing will begin upon receipt or clearance of the check.

- PayPal

The PayPal system is an electronic payment service that allows customers to pay for purchases, receive payments, or send and receive money. They can use this service to make one-off or one-time payments, or they can open a PayPal account to make regular payments. More information is available on the website: www.paypal.fr

- Species

If the customer comes to collect their order from Moto Nord de France, they can pay in cash.

Default on payment:

Moto Nord de France reserves the right to refuse to make a delivery or to honor an order from a customer who has not paid in full or in part for a previous order or with whom a dispute is being administered.

Shipping and delivery:

Moto Nord de France ships the products offered on the website www.motonorddefrance.com to various countries. Shipping costs will be calculated automatically based on the destination. Even if shipped carriage paid, goods travel at the recipient's risk. In case of claims, the customer is responsible for contacting the delivery service. In accordance with the French Commercial Code, Article 103 et seq., packages must be inspected upon delivery. In case of damage, the customer must make specific written reservations with the carrier. Exchanges or reshipments will only be processed if all these conditions are met. Moto Nord de France cannot be held liable for delivery delays caused by carrier failures of any kind.

Delivery :

- Delivery costs

Shipping costs are calculated based on an estimate of the weight of the items ordered, including their packaging, and the chosen delivery method. Order confirmation implies acceptance of the automatically calculated shipping costs, which are displayed in the order summary.

- Delivery time

Delivery time may vary depending on:

• The supply lead time

If the desired item is not in stock, it takes us 2 to 30 days to receive it from our supplier.

• The preparation time

The customer should generally allow 2 days for preparation (order processing, invoicing, product preparation, packaging).

• The transport time

In France, delivery by La Poste takes approximately 48 hours, while Mondial Relay takes 3 to 6 days. These delivery times are those provided by the carriers and are given to the customer for informational purposes only. Therefore, Moto Nord de France cannot be held liable for any failure by the carriers to meet these delivery times.

- Absence on the day of delivery

If you are not home, the carrier (La Poste) will leave a delivery notice; you can then collect your package directly from your local post office, which will keep it in its warehouse for 15 days.

- Delivery location

By default, products are delivered to the billing address provided by the customer when placing their order. If the delivery address differs from the billing address, the customer must specify this in addition to the billing address when placing their order.

Cancellations and incorrect orders:

- Withdrawal

In accordance with the French Consumer Code, you have 14 calendar days from the date of delivery to return a product for exchange or refund. The product must be returned at your expense and under your responsibility, and it must be:

• In its original sealed packaging,

• Completely intact,

• In perfect condition for resale,

• Comes with all accessories and the purchase invoice.

Any merchandise returned in a non-compliant manner will be refused.

- Incorrect commands

In accordance with the French Consumer Code, an item ordered incorrectly by the customer may be returned within 14 days of receipt. In this case, Moto Nord de France will charge 20% of the total amount of the returned products, with a minimum of €5, to cover restocking and handling costs. Returns will only be accepted for new goods in their original condition and without any damage.

Returned goods must be:

• In their original sealed packaging,

• Complete with all original accessories and peripherals supplied with the product,

• Completely intact,

• In perfect condition for resale,

• Accompanied by the purchase invoice,

Shipping costs are the responsibility of the customer. Refunds will be processed within 14 days of verification of all required information. Only the cost of the returned items will be refunded.

Guarantee :

All parts intended for track use are sold without warranty. Moto Nord de France cannot be held liable for any damage resulting from misuse. Some products modify, or may modify, a vehicle's homologation specifications, rendering it unfit for road use. As these products are intended solely for closed-circuit racing, their use on public roads is prohibited by French law.

- New parts

The products are covered by a manufacturer's warranty for a specified period, available upon request and not by the distributor. This warranty is only applicable if the product has not been used abnormally or modified. The manufacturer's warranty is void if the product is intended for competition or if the defect results from assembly performed by an unauthorized or incompetent person. The manufacturer is solely responsible for accepting or rejecting warranty claims. If the manufacturer refuses warranty coverage, Moto Nord de France cannot be held liable and will not provide this warranty in place of the manufacturer. All returns of products under warranty are at the customer's expense; only the return shipping of the repaired or replaced product will be covered by the manufacturer or Moto Nord de France.

- Used parts

Used parts are guaranteed for 3 months. For the warranty to apply, installation must be carried out by a motorcycle professional and documented with an invoice. Engines sold "for parts" are considered out of service and are therefore not covered by the warranty.

Approval of articles:

The use of non-approved accessories and items that can modify vehicle characteristics is restricted to competitions whose regulations normally permit it. Their use on public roads is strictly prohibited. The purchaser of non-approved parts cannot, under any circumstances, claim that they were not informed of the non-approval of the goods sold. Any modification of the vehicle's characteristics compared to its homologation renders it unfit for road use.

Disputes:

In the event of a dispute, the customer should first contact the company to seek an amicable solution. Failing that, the Commercial Court of Valenciennes shall have sole jurisdiction, regardless of the place of delivery or the payment method used. This contract is governed by French law. Moto Nord de France cannot be held liable for damages of any kind, whether material, immaterial, or physical, that may result from malfunction, misuse, or assembly of the products sold by an unqualified person. The same applies to any modifications to the products made by the manufacturers. In any event, Moto Nord de France's liability shall be limited to the amount of the order and cannot be invoked for simple errors or omissions that may have occurred despite all precautions taken in the presentation of the products.
